On June 14, 2017, three (3) Fresh Air limited liability corporations filed a complaint against Duke Energy Progress, LLC (DEP).  On June 15, 2017, Fresh Air II, LLC, filed a complaint against Duke Energy Carolinas, LLC (DEC). In its complaints Fresh Air asserts that DEP and DEC have not complied with Commission deadlines for completing the studies needed prior to interconnecting their planned solar photovoltaic energy facilities to the utilities’ electric distribution systems. Fresh Air also alleges that DEP and DEC violated the requirements of the federal Public Utilities Regulatory Policies Act (PURPA). DEP and DEC state that they’ve made reasonable efforts to process and study Fresh Air’s interconnection requests.  The Commission has required the filing and appearance of expert witness testimony in order to resolve the dispute.
